MOREPEP Terms of Use

more.PEP in Style, owner. Erwin Blase ("MOREPEP") operates the travel website www.morepep.com ("Website") for travel under the conditions set out below. These general terms and conditions regulate the use of the website and the contractual relationship between MOREPEP and the user. 

  1. Scope of application, subject matter of the contract

These terms and conditions apply exclusively to the users of the website. Deviating terms and conditions of the user towards MOREPEP are contradicted subject to an individual agreement and they do not apply.

  1. Requirements for using the travel services offered

2.1 The subject of the contract between MOREPEP and the user is the possibility of using the website for the conclusion of travel contracts. MOREPEP is the operator of the website.

2.2 All travel services and special conditions offered by MOREPEP are only valid for people who work full-time for tour operators, travel agencies, airlines, or other tourism companies. The applicant must be regularly employed or be self-employed in the travel trade (see below, group of beneficiaries *). Proof of self-employment must be in writing (trade license or similar) and must also include evidence of their active sales or services on an up-to-day website

2.3 Appropriate legitimation or work confirmation (company or agent photo ID with validity date, membership ID of a travel trade association, etc.) must be uploaded to the customer account when registering online. travellers are obliged to identify themselves accordingly upon request and to present the original proof at any time. If the traveller cannot properly legitimize himself, this may lead to a subsequent charge at the normal tariff without special conditions or even to the exclusion of benefits. MOREPEP and its service providers reserve the right to cancel bookings for a fee, even after confirmation has already been given, in the event of insufficient or pretended legitimation at the time of the start of the journey, and in this respect have a special right of termination due to deception. They are also authorized to exclude the registered user from use with immediate effect (account deletion) and to refuse a new registration.

2.4 Unauthorized use: MOREPEP expressly reserves the right to check the information provided for registration and to initiate appropriate legal measures under -  § 263 StGB - Section 263 of the German Criminal Code - in the event of a violation or false pretences. Intentional, unauthorized use of the special conditions can be prosecuted in individual cases and can also affect employers who give unauthorized third parties (business partners, friends, acquaintances, etc.) access to MOREPEP's offers.

2.5 MOREPEP is not liable for incorrect data stored by the user (e. g. residential address, email address or telephone number) and the resulting impairments and (financial) disadvantages. The user is obliged to notify changes to his personal immediately and/or to update them independently in his user profile on www.morepep.com.

2.6 The special conditions published here may not be communicated to third parties who do not belong to the group of users specified below.

2.7 Proven discounts apply exclusively to the price of accommodation and not to meals. The acceptance deadline for offers with special conditions (free nights, discounts, etc.) is 6 p.m. on the respective day of validity. The booking deadlines for special offers stated in the advertisement apply without exception and cannot be changed. The tourist tax levied in some places is payable directly on departure.

2.8 The price calculation for children is based on the age of the child upon the day of departure. The maximum number of people (adults and children) stated in the room description is binding. The user is responsible for the correct entry of the age of all travellers (adults and children). 

 

  1. MOREPEP's scope of services towards the user

3.1 The services of MOREPEP towards the user consist in the availability of the options for using the website and in the advice on the travel offers posted on the website. A travel contract is concluded separately by booking. For this, the general travel conditions of MOREPEP apply.

3.2 MOREPEP reserves the right to change or expand the content and structure of the website and the associated user interfaces. 

 

  1. Duration of the contract, chargeable use, termination

4.1 The user can request the deletion of his registration and the corresponding data from MOREPEP by sending a message per email to accounting@morepep.com and terminate the user contract at any time.

4.2 MOREPEP is entitled to terminate the user contract and to block the login option of the user or to delete all data provided for registration if 

  1. 3 months after the previously-stored tourism professional certificate has expired, no new credential has been uploaded online in the customer account. 
  1. No booking was made by the user for 18 months since the last login. 

The user is not entitled to admission or re-admission. 

4.3. MOREPEP is entitled to extend the user contract for a fee if no booking has been made within at least 18 months since the user's last access renewal. Re-access to morepep.com is then only possible after paying a usage fee of EUR 150.00. Access is then valid for a further 18 months and the amount will be charged in full if the user makes a booking of at least 1,200.00 euros during the period of use. 

 

  1. Limitation of liability for hyperlinks

5.1 MOREPEP is liable in the context of the usage contract in the event of wilful intent and gross negligence. In the case of slight negligence, MOREPEP is only liable if an essential contractual obligation (cardinal obligation) is violated. In these cases, the claim for damages against MOREPEP is always limited to the damage typical for the contract that is foreseeable as a possible consequence of the contractual relationship when the contract was concluded. This limitation of liability does not apply to compensation for damage due to injury to life, limb, or health.

5.2 In the case of direct or indirect references from the MOREPEP website to third-party websites ("hyperlinks") that are outside the area of responsibility of MOREPEP, if it is technically possible and reasonable for MOREPEP to prevent the use of illegal hyperlinks. The links that have been set have been carefully researched and compiled. MOREPEP declares that at the time the links were set, no illegal content was recognizable on the linked pages. MOREPEP does not influence the current and future design, content, or authorship of the linked or connected pages. MOREPEP expressly distances itself from all content on linked pages that has been changed after the link was set and expressly does not adopt its content as its own. For illegal, incorrect, or incomplete content and in particular for damage resulting from the use or non-use of such information, only the provider of the page to which reference was made is liable, not the person who merely refers to the respective publication via links. 

 

  1. Duty to provide information on the identity of the operating airline

According to EU Regulation No. 2111/05, the tour operator is obliged to inform the traveller about the identity of the respective airline of all air transport services to be provided in the context of the booked trip when booking. If the operating airline or airlines have not yet been determined at this point, the tour operator must name the airline (s) that are likely to carry out the flight and ensure that the user is immediately informed of the identity, as soon as this is established, or these are established. The same applies if the operating airline changes. The tour operator must immediately take all reasonable steps to ensure that the user is informed of the change as soon as possible.   1. Data protection

7.1 MOREPEP informs the user about the processing of personal data in the data protection declaration on the website and in the data, protection notice when contacting us. When processing personal data, MOREPEP complies with the provisions of the BDSG and the GDPR. Personal data are all data that relate to a person personally (e. g. name, address, email address). This data is processed to the extent that it is necessary for the appropriate processing of an inquiry, booking request, for the implementation of pre-contractual measures or the fulfilment of the contract arising from the usage or travel contract. The data processing is permitted according to Art. 6 Para. 1 S. 1 lit. b GDPR for the stated purposes. Data will not be passed on to unauthorized third parties without the express consent of the user. The user has the option at any time to call up his stored personal data, to request information about it, to have it changed, corrected or deleted, to have its processing restricted to object to its processing, to have it transferred or to contact a supervisory authority about the To complain about processing (all rights of Art. 15 to 20 GDPR). The data will be deleted if they are no longer required for the performance of the contract or if their storage is not permitted by law. 7.2 By sending a message to accounting@morepep.com, the user can object to the use or processing of his or her data for advertising, market or opinion research purposes. Details on data protection can be found in MOREPEP's data protection declaration on its website, which is expressly referred to, as well as in the data protection notice that is clicked on when booking. 

 

  1. Final provisions, notes

8.1 Only German law applies to the user contract between the user and MOREPEP. If the user is a merchant or legal entity under private or public law or a person who has their domicile or habitual abode abroad, or whose domicile or habitual abode is not known at the time the action is brought, the place of jurisdiction is agreed to be the registered office of MOREPEP.

8.2 The ineffectiveness of individual provisions of these terms and conditions does not result in the ineffectiveness of the entire contract.

8.3 The European Commission provides a platform for online dispute resolution (OS) for the out-of-court settlement of consumer disputes, which the user can find at https://ec.europa.eu/consumers/odr. MOREPEP does not take part in a dispute settlement procedure before a consumer arbitration board and is also not legally obliged to participate in such procedures. There is no internal complaint procedure.
